Terms of Service

These Terms of Service ("Terms") govern your use of Permafrost EPM ("the Service"), operated by Dune Software Studios ("Permafrost," "we," "us"). By creating an account or signing in, you agree to these Terms.

1. The Service

Permafrost is a Cloud Infrastructure Entitlement Management (CIEM) product that analyzes identity and permission state across Microsoft cloud surfaces. The Service is read-only against your tenant.

2. Acceptable use

You agree not to:

  • Use the Service to analyze any tenant for which you do not have explicit administrative authority
  • Attempt to probe, scan, or test the vulnerability of the Service or to circumvent its access controls
  • Use the Service to interfere with or disrupt the integrity or performance of any Microsoft cloud or any other third-party service
  • Reverse-engineer, decompile, or attempt to derive source code from the Service
  • Resell or sublicense the Service without our written consent

3. Subscription and billing

The Service is offered across multiple tiers. The current tier definitions, included limits, retention windows, and unit prices are published at permafrostepm.com/pricing and are incorporated into these Terms by reference. Paid tiers are billed monthly via Stripe; object counts are computed daily and charges are prorated for the billing period.

Failed payments may result in suspension of sync and dashboard access. We will notify you by email before any service interruption.

4. Cancellation

You may cancel your subscription at any time through the Stripe Customer Portal accessible from the dashboard. Cancellation takes effect at the end of the current billing period; usage already consumed is non-refundable. After cancellation, your account remains active on Community Edition. If your tenant exceeds Community Edition's included object count, sync is paused until usage falls back inside the included limit or a Professional Edition subscription is reactivated.

5. Intellectual property

You retain all rights to your tenant data. Permafrost retains all rights to the Service, including the analysis logic, the generated findings, and the recommended-role outputs. You may use those outputs internally without restriction.

6. Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PERMAFROST IS A READ-ONLY ANALYSIS TOOL; YOU REMAIN RESPONSIBLE FOR ALL CONFIGURATION CHANGES TO YOUR AZURE TENANT.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PERMAFROST'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO PERMAFROST IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL PERMAFROST BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.

9. Changes to these terms

We may update these Terms from time to time. Material changes will be announced by email and via an in-app banner at least 30 days before taking effect.
